Default CA STATE LAW REDEMPTION

We have a dog that may be released back to its owner pending a potentially dangerous investigation. We want to have the owner sign a redemption agreement prior to the dog's release. Is there a CA law that applies that the owner must be able to control the dog at all times? The dog has not been declared yet. Thinking of statue more than the leash law.

Something to this effect "the owner of an animal must demonstrate, prior to redemption, ownership of the animal and also the ability to keep the animal in conformance with the requirements".
